Terms of Service
Last updated October 28, 2026
Draft. This policy is pending legal review and may change before launch.
These terms are an agreement between you and DonorSecure, LLC ("DonorSecure", "we", "us"), based in Atlanta, GA. They cover your use of DonorSecure, including our website, donation pages, dashboard, API and webhooks (the "Service"). By creating an account or using the Service, you agree to them.
1. What DonorSecure is
DonorSecure is software that helps nonprofit organizations accept and manage donations. We are not a bank, payment processor, money transmitter, fundraiser or charity. Payments are processed by Stripe, Inc. ("Stripe") on each organization's own Stripe account.
2. Accounts
- You must be at least 18 and able to agree to these terms for yourself and for any organization you register.
- You're responsible for your login, for the people you invite to your organization and the roles you give them, and for activity under your account.
- Tell us right away at support@donorsecure.com if you think your account has been accessed without permission.
3. Payments and Stripe
- To accept gifts, an organization connects its own Stripe account and agrees to Stripe's terms, including the Stripe Connected Account Agreement. The organization is the merchant of record for every gift.
- Gifts are charged on the organization's Stripe account and paid out by Stripe. We never hold, receive or control the organization's funds.
- Stripe's processing fees are charged by Stripe to the organization. We don't set or receive them.
- Stripe may verify, limit or close an organization's Stripe account under its own terms. We aren't responsible for Stripe's decisions.
4. Fees and donor tips
- We don't charge organizations a subscription or a platform fee on gifts.
- Donors may choose to add an optional tip to their gift. Tips are collected with the gift and shared between the organization and DonorSecure. Our share is collected by Stripe as an application fee on the same charge.
- Organizations control whether a tip is suggested and how much. When a gift is refunded, our share of its tip is refunded in proportion.
- We may introduce paid features in the future. We'll tell you before anything you use starts to cost money.
5. Organization responsibilities
If you register an organization, you're responsible for:
- Being who you say you are, and having authority to accept gifts for the organization.
- Your organization's tax status and any charitable solicitation registrations required where you raise money.
- The accuracy of your donation pages, campaigns and receipts, including any statements about tax deductibility.
- Using gifts as described to donors, handling donor questions, and issuing refunds and resolving disputes through Stripe.
- Handling donor information lawfully and in line with your own privacy policy.
6. Acceptable use
You may not use the Service to:
- Raise money for anything illegal, fraudulent or misleading, or that violates Stripe's restricted business list.
- Impersonate another person or organization, or collect gifts for an organization you don't represent.
- Send spam, upload malware, or probe, overload or work around the Service's security or limits.
- Access other organizations' data, or scrape or resell the Service.
Supporters who create fundraising pages must follow these rules too, and organizations may approve or remove those pages.
7. API, webhooks and custom domains
You may use our API and webhooks to connect your own systems, within the documented rate limits. Keep API tokens and webhook signing secrets confidential. If you add a custom domain, you must control it and keep its DNS record pointed at us while it's in use.
8. Your content and data
Your organization owns its content and donor data. You give us permission to host, process and display it only as needed to run the Service for you. Our Privacy Policy explains how we handle personal information.
9. Suspension and termination
You can stop using the Service at any time. We may suspend or close an account that breaks these terms, puts donors or the Service at risk, or is required to be closed by law or by Stripe. Where we reasonably can, we'll give notice first. An organization with gift records is deactivated rather than deleted so its records stay available.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted or error-free.
11. Limitation of liability
To the extent the law allows, DonorSecure, LLC won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost gifts, revenue, profits or data. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount of tips we received from your organization's gifts in the 12 months before the claim.
12. Indemnity
If you register an organization, you'll defend and indemnify DonorSecure, LLC against claims arising from your organization's fundraising, use of gifts, content, or breach of these terms.
13. Changes
We may update these terms. If a change is material, we'll notify account owners by email or in the app before it takes effect. Continuing to use the Service after that means you accept the updated terms.
14. Governing law
These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Fulton County, Georgia.
